Abstract

Among the Hanafi jurists, Abu Zayd Ubaidullah bin Umar bin Isa Al-Dubosi is one of those who critically and profoundly evaluates the original jurisprudence and diverges the jurisprudential opinions of the imams of the Hanafi school of thought. Imam Dabusi is one of the Imams of the fifth century AD, who was born in a village called Dabusiya between Bukhara and Samarkand and died in 430 AH. His book "Taasis al-Nazar" is an important effort in the field of original jurisprudence in the fifth century Hijri, the precedent of which could not be found in the next two centuries. Mohammad Al-Qabani, researcher of "Tasis al-Nazar" writes that Imam Dabusi is the first person who passed the issues of Khilafah between Arbaa imams through revision and cultural stages. Two manuscripts of "Taasis al-Nazar" are preserved in Maktabat al-Khadiwiyyah under No. 111 and No. 118. With the help of these manuscripts, Al-Qabani carried out the service of researching this book, the manuscript of which was published in 1415 by the Al-Khanji School in Cairo. In this article, the principles of disagreement between the three imams and Imam Malik and Ibn Abi Laila and the various rulings on them have been reviewed.
