Abstract
Mudarabat, Mudarabah refers to a contract in which one party is the owner of money, who gives capital, and the other party is the Mudarib, who works or works, and the profit is divided between the two. and it has its own rules, while according to Malikiyyah, Mudarabat is a type of participation. Keeping in mind the human need, the Holy Shariat has declared the matter of Mudarabat as legitimate. Therefore, all imams agree on its justification.
The Hanafi's position is that it is not permissible to agree and accept the contract of mudarabat and to make mudarabah with offerings, that is, goods, while according to Malikiyyah, it is permissible, and Malikiyya's opinion has priority in the present age. There is a difference between the two religions in terms of abusing the obligatory religion on another person and abusing the entrusted property, and the Hanafi religion has priority in the present age.
